NOTICE OF MORTGAGE FORECLOSURE SALE

YOU ARE NOTIFIED THAT:
1. Default has occurred in the conditions of the Mortgage dated October 31, 2006, executed by Paul R. Meleen and Holly Meleen, husband and wife, as mortgagors, to Mortgage Electronic Registration Systems, Inc., solely as nominee for Winstar Mortgage Partners, Inc., as mortgagee, recorded on November 2, 2006 as Document Number 336967; which Mortgage was assigned to US Bank National Association, as Trustee, successor in interest to Bank of America, National Association, as Trustee (successor by merger to LaSalle Bank National Association) as Trustee for Morgan Stanley Mortgage Mortgage Loan Trust 2007-3XS, pursuant to an Assignment of Mortgage, dated May 2, 2011 recorded on May 10, 2011 as Document Number A367380, in the office of the County Recorder of Mille Lacs County, Minnesota. The land described in the Mortgage is not registered land.
2. The original principal amount secured by the Mortgage was $308,000.00.
3. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
4. No mortgagor has been released from financial obligation on the mortgage.
5. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.
6. At the date of this notice the amount due on the Mortgage, and taxes, if any, paid by the holder of the Mortgage is $326,381.61.
7. Pursuant to the power of sale in the Mortgage, the Mortgage will be foreclosed, and the land described as follows:
Legal Description: All that part of Government Lot 5, Section 8, Township 43, Range 25, described as follows to wit: Starting at a point on the west line of Government Lot 5, Section 8, Township 43, Range 25 of Mille Lacs County, Minnesota, said point being where said west line intersects with the south right of way line of the township road; thence running east to a point on said South right of way line which would intersect a line parallel to and 200 feet east of the west line of said Government Lot 5, for the point of beginning of the tract to be hereby conveyed; thence continuing east along the south line of said township road to a point where said south line of said road would intersect a line parallel to and 385 feet east of the west line of Government Lot 5, thence running south parallel to the west line of Government Lot 5 a distance of 385 feet more or less to the lake shore of Mille Lacs Lake; thence running west along the lake shore of Mille Lacs Lake to a point where said lake shore would intersect a line parallel to and 200 feet east of the west line of Government Lot 5; thence running north parallel to the west line of Government Lot 5 to the point of beginning, according to the United States Government Survey thereof and situate in Mille Lacs County, Minnesota
will be sold by the Sheriff of Mille Lacs County, Minnesota, at public auction on January 30, 2014 at 10:00 a.m. at the office of the Mille Lacs County Sheriff, 640 Third Street SE, Milaca, Minnesota.
8. The mortgagor must vacate the property on or before 11:59 p.m. July 30, 2014, if the mortgage is not reinstated under Minn. Stat. Sec. 580.30, the property is not redeemed under Minn. Stat. Sec. 580.23, or the redemption period is not reduced under section 582.032.
9. The time allowed by law for redemption by Mortgagors or Mortgagors personal representatives or assigns is 6 months after the date of sale.
10. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGORS PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
11. THE RIGHT TO VERIFICATION OF THE DEBT, INCLUDING A DEBT DISCHARGED BY A BANKRUPTCY, WHICH DEBT IS SECURED BY THE MORTGAGE, AND IDENTITY OF THE ORIGINAL MORTGAGEE IS NOT AFFECTED BY THIS ACTION. THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
